Employment Law Newsletter: Change is Coming Soon: The New FLSA Regulations

Diane Tindall of the Wyrick Robbins Employment Law Group discusses updated U.S. Department of Labor regulations relating to employers’ overtime obligations. The new regulations, which take effect in December 2016, will require employers to either raise the salaries of some white collar employees who are now exempt from the overtime requirements of the Fair Labor Standards Act or to reclassify these employees as non-exempt and pay them time and a half for any hours worked in excess of 40 in any work week. The impact of the new rules will be significant: because the salary threshold has not been changed since 2004, the new threshold nearly doubles the amount a white collar worker must receive in order to remain exempt.
