Bio

Charles is a trial attorney whose practice focuses on complex commercial litigation and certificate of need disputes. His experience includes representing clients in intra-company disputes, commercial contract breaches, employment disputes, trade secrets and intellectual property disputes, real estate disputes, product liability, significant personal injury, property damages and insurance cases, as well as other litigation matters.  He has represented clients as lead counsel through all stages of litigation, including jury and non-jury trials, and in appeals.  He has litigated matters in the North Carolina Business Court, all of North Carolina’s Federal District Courts, the North Carolina Court of Appeals, the North Carolina Supreme Court and the Fourth Circuit Court of Appeals.  He has also been lead counsel in numerous arbitrations through the American Arbitration Association. He also has significant experience representing medical professionals before state licensing boards and represents individuals and corporations in certificate of need and other matters in the Office of Administrative Hearings.
 
 
Charles is the law firm’s General Counsel and a past member of the firm’s Executive Committee. Charles received his B.A. in Economics from the University of Michigan, Ann Arbor. He received his M.B.A. from Penn State University-University Park and his J.D., cum laude, from the University of Miami School of Law.

  • Represented national hospital corporation at trial and on appeal in securing first new hospital in Buncombe County in 100 years.
  • Represented multinational company in misappropriation of trade secrets case involving formula used in product manufacturing process, including successfully defending unfair trade practices counterclaim brought against company.
  • Represented multinational company in products liability lawsuit, including obtaining summary judgment on claims for fraud and punitive damages allowing for favorable settlement.
  • Obtained defense verdict in 4 week jury trial on behalf of oral surgeon where demand was in excess of $10 million.
  • Obtained Summary Judgment for a municipality for claims for writ of mandamus, mandatory injunction, and alleged constitutional violations arising out of actions with respect to special use permit.
  • Obtained Dismissal of claims for fraud, constructive fraud, and breach of fiduciary duty attempting to attack decision by shareholder/directors to allocate payments to various limited liability companies included in $30M+ transaction.
