Overview
Wyrick Robbins is one of the few firms in North Carolina that represents clients in a range of industries including education, technology, health services, construction, professional services, defense, and transportation in government contracting matters. With over fifty (50) years of combined experience, our Government Contracting Practice Group has the expertise to handle a wide variety of issues that face government contractors, including:
North Carolina Procurement Counseling, Bid Protests, Contract Disputes, and Litigation:
- Advising clients on drafting proposals, quotes, and bids, and responding to RFPs, RFQs, IFBs, and other solicitations;
- Representing clients in bid protests before the North Carolina Office of Administrative Hearings, the North Carolina Department of Information Technology, and other North Carolina State agencies;
- Advising on statutory and regulatory compliance issues, including:
- State-specific IT terms and security standards; and
- North Carolina procurement rules for public agencies, universities, and local governments.
- Advising companies on questions and disputes concerning state and local government contracts and procurements.
Federal Procurement Counseling, Bid Protests, Contract Disputes, and Litigation:
- Representing clients in bid protest actions before the Government Accountability Office and the United States Court of Federal Claims.
- Negotiating government contract disputes and pursuing contractor claims before the United States Court of Federal Claims and various Boards of Contract Appeals.
- Assisting small business concerns, 8(a)-certified companies, HUBZone small businesses, service-disabled veteran-owned small businesses, and woman-owned small businesses navigate the United States Small Business Administration regulations, including regulations regarding size determinations, affiliation issues, and permissible teaming and joint venture arrangements.
- Defending against and pursuing size, HUBZone, and other protests before the United States Small Business Administration.
- Representing government contractors in suspension and debarment proceedings.
- Defending contractors during Inspector General investigations and in actions brought in the United States District Courts pursuant to the False Claims Act.
- Defending clients against whistleblower complaints made to the United States Department of Labor.
Representative Experience:
- Successfully defending Aetna Life Insurance Company in litigation brought by Blue Cross and Blue Shield of North Carolina challenging the North Carolina State Health Plan’s award to Aetna of a $10 billion contract to provide third-party administrative services pursuant to an RFP here.
- Successfully defended size protest in the Office of Government Contracting of the U.S. Small Business Administration concerning Service-Disabled Veteran-Owned Small Business set aside contract.
- Prevailed in a bid protest filed on behalf of a disappointed bidder, obtaining cancellation of a contract for elevator services awarded by the University of North Carolina at Chapel Hill.
- Successfully represented Petitioner, Union Supply Group, Inc., in litigation against the North Carolina Department of Public Safety challenging the award of a multi-million-dollar contract for the NCCE Offender Packaging Program to another company pursuant to an RFP, resulting in reversal of the agency’s decision and award of the contract to Union Supply Group, Inc.
- Represented Carolina Complete Health, a joint venture between Centene Corporation and the North Carolina Medical Society, in litigation challenging the State of North Carolina’s award of contracts for prepaid health plans valued at $30 billion in the Medicaid Transformation process.
- Successfully challenged termination for default of client by government in United States Court of Federal Claims, negotiating conversion of termination for default to termination for convenience, and obtaining settlement damages for our client.
- Negotiated settlement of less than $10 million and continuation of client’s business without suspension or debarment after 5 years of litigation in United States District Court for the District of Columbia in which the government sought recovery of damages in excess of $1 billion against our client.
- Obtained dismissal of whistleblower complaint alleging violations of the Sarbanes Oxley Act before the Occupational Safety and Health Administration.
