Bio

Ben is Chairman of the Litigation Section and his practice focuses on complex litigation, government contracting law, labor law, government investigations, and trade regulation. He has extensive jury and non-jury trial experience in both state and federal courts throughout the country, as well as before the U.S. Court of Federal Claims, the U.S. Government Accountability Office, Armed Services Board of Contract Appeals, Civilian Board of Contract Appeals and the National Labor Relations Board. He has also represented a number of companies and individuals in response to government investigations and civil investigative demands. He represents a number of large- and medium-size government contracting, financial services, manufacturing, and health-care companies.

Ben graduated from Campbell University where he received his B.A., cum laude, and his J.D.

  • Co-counsel in an action filed in The North Carolina Office of Administrative Hearings, successfully defending a challenge by a disappointed bidder in connection with a $10 billion contract for administration of a health benefit plan for state employees and retired employees.
  • Lead trial counsel in a premises liability case where the jury returned a verdict of $2.75 million in favor of our client for injuries sustain in an assault which occurred at a nationally franchise hotel and restaurant.
  • Lead trial counsel for the plaintiff in a products liability case where a negotiated settlement of $8.75 million was reached including a significant life care plan for our client.
  • Lead trial counsel in a Delaware trade secret and breach of non-disclosure agreement against a former employee where our client received permanent injunctive relief and monetary damages.
  • Lead counsel in a case before the United States Court of Federal Claims where our client successfully challenged a termination of a government for default where the termination was negotiated to a termination for the convenience of the government and settlement damages were received by our client .
  • Lead counsel in a case in filed United States District Court for the District of Columbia filed against a government contractor where the government sought recovery of damages in excess of $1 billion against our client, which was successfully negotiated after 5 years of litigation to a settlement of less than $10 million and continuation of business without suspension or debarment.
  • Lead counsel in a trade secrets and trade dress action filed in United States District for the Southern District of Texas.
  • Lead counsel in an action filed in the North Carolina Office of Administrative Hearings, successfully challenging a contract award to a competitor resulting in a finding of arbitrary and capricious conduct on the part of the procuring agency and the Tribunal ordering the award of a new contract to our client.
  • Successfully negotiated a global settlement of a 15-year class action against an agricultural cooperative of farmers in 5 states.
